Assalamu Alaikum: Peace Be With You

What is Revocation (Ruju)?

Question:

Assalamu alaykum

My question is in regards to sex during the idaat period. Is it permissable during the idaat period? If so, how many times? And if you do have sex during the idaat period, does it mean that you have agreed to continue with the marriage? Insha allah, please clear up this issue for me.

 Jazakallahu Khayran

Aanswer:

WaAlaikum Assalam and thanks for contacting. dear Michael Harris!

Let us first see what Iddat really is?

When a lady is divorced once or twice, Shariah asks her to wait for about 3 months (clearance from 3 menstrual periods), or in case of pregnancy, the delivery of baby, before deciding fresh marriage with some other person. Now, if the divorcing husband has sex within this waiting period, it means he has revoked (technically called ruju') and wants to continue the marriage. In case of one or two divorce announcements, he is given right of ruju'. However, after 3 divorces, he is no more allowed to exercise that right. The spouses will be separated instantly. They can not even re-marry without legitimate halala.
