Provincial Organisation: Scope and Set-up
1. Scope and Set-up (Article 38)
1. Pakistan may be
divided into Organisational Provinces for the Jamaats organisational
requirements.
2. The provincial set-up
shall comprise of the Provincial President, Provincial Council, and Provincial Secretary;
unless the circumstances demand for some other set-up as a temporary arrangement.
3. Obedience of the
Provincial set-up shall be binding on the Jamaat members of the province.
2. The Provincial President (Article 39)
A person shall be
responsible for the Provincial set-up, to be called "Provincial President". His
position in his province shall be that of a representative of the Central President, to
whom he shall be answerable.
Appointment and
Dismissal (Article 40)
1. The power to
appoint and dismiss the Provincial President shall be with the Central President who shall
give due consideration to the opinion of members from the province besides keeping in view
the interests of the Jamaat.
2. The appointment for
the office of the Provincial President shall be of three years.
The Oath (Article 41)
Before taking charge of
office, the Provincial President shall take oath before the Central President or a person
or persons appointed by him, as given in Appendix 1 of this Constitution.
Duties and Powers of
the Provincial President (Article 42)
The duties of the
Provincial President shall be as follows:
- Spread of the Jamaats Call,
mission, policies and program in the province, and to take necessary steps for their
realisation.
- Carrying out Centres directives and
arrange for timely payment of Central dues.
- Keeping the Centre informed of conditions
in the province and of the work of Jamaat in the province.
- Supervision, guidance and accountability of
the subordinate units, departments and institutions and their staff and workers in the
province.
- Taking timely notice and steps on issues
pertaining to or affecting the mission and objective of the Jamaat in the province.
- Execution of duties and responsibilities as
may be assigned by the Centre.
Article
43
The Provincial
President shall have following powers:
- Appointment and dismissal of the Provincial
Secretary in consultation with the Provincial Council.
a. Selection of his
Working Committee from amongst the members of the Provincial Council.
- Appointment and dismissal of personnel in
Provincial Departments.
- Convening the sessions of Provincial
Council and of Executive Committee.
- Expending from the Provincial Fund
according to the budget approved by the Provincial Council, and take appropriate and
necessary steps for performing his duties according to the Constitution,
- Using in province the power that is vested
in the Central President as per Article 19 (4b).
- Exercise of powers that the Central
President may delegate to him.
3. Provincial Council
Composition and Tenure
(Article 44)
- The Provincial Council shall be directly
elected by the members in the province.
- The Provincial President shall determine
the number of the members to the Provincial Council. Before an election, the Provincial
President or his appointed Election Supervisor shall determine appropriate constituencies
by distributing this strength in proportion to the number of members in each constituency.
- At least three months ahead of the
Councils elections, the Provincial President shall appoint an Election Supervisor
and vest him with powers required for conducting the elections.
- Members of the Council shall be elected for
two years.
- The Provincial President shall be the Chair
of the Provincial Council, and Provincial Secretary its ex-officio member and secretary.
Inaugural Session (Article 45)
The Provincial
President shall convene the inaugural session of the new Council within two months of the
election, where every member shall individually take the oath before the Provincial
President in accordance with Appendix 2 of this constitution. Afterwards, the Provincial
President shall apprise them about their duties and responsibilities as well as prevalent
situation and state of affairs of the Jamaat in the Province.
Relationship between
the Provincial President and the Provincial Council (Article 46)
- Except for the day-to-day affairs, the
Provincial President shall decide on all the important matters in consultation with the
Provincial Council.
- In case of discord between the Provincial
President and his Council, the case shall be referred to the Central President.
The Session (Article 47)
The ordinary session
of the Provincial Council shall be held once in a year.
Article
48
Extraordinary session of
the Provincial Council may be convened any time under the following conditions:
- The Provincial President considers it
necessary.
- At least 1/4th of the Council members
requisitions it in writing.
- The Provincial Department for
Organisational Affairs, in case of absence of the Provincial President, finds it
necessary.
- The President orders holding its session.
Duties and
responsibilities of the Council (Article 49)
The duties of the
Provincial Council shall be as are stated in the oath of membership of the Council
(Appendix 2), and the powers of the Council are as follows:
- Giving expression to opinion through the
passage of resolutions or statements on issues pertaining to and affecting the mission and
objectives of the Jamaat, provided that they are not against any general or specific
policy of the Centre.
- Accountability of the performance of the
Provincial Jamaat and subordinate units.
- Approval of the provincial budget.
- Adoption of confidence or no-confidence
resolution for or against the Provincial President.
4. Provincial Secretary
General
Appointment and
Dismissal (Article 50)
The Provincial
President shall appoint the Provincial Secretary in consultation with his Council who
shall remain in office as long as the Provincial President is satisfied with his work.
Duties (Article 51)
The Provincial Secretary shall be the
aide and representative of the Provincial President in all matters of the Jamaat in
his province, and shall execute the duties assigned to him by the Provincial President and
shall be answerable to him.
The
Oath
Before taking charge of office, the
Provincial Secretary shall take oath of office before the Provincial President as given in
Appendix 3 of this Constitution.
5. Provincial Working
Committee
Appointment, Status and
Powers( Article 51 a)
- There shall be a Working Committee of the
Provincial Jamaat, which shall consist of maximum 10 members whom the Provincial
President shall select from amongst the members of the Provincial Council. Provincial
President shall be its Chair, Provincial Secretary its ex-officio member and secretary,
and Vice President(s), if any, its ex-officio member(s).
- If one ceases to be a member of the
Provincial Council, shall also cease to be a member of the Provincial Working Committee.
The Provincial President
can convene the session of the Provincial Working Committee whenever and as many times as
he deems necessary.
The quorum for the
Provincial Working Committee session shall be half of the total number of its members.
A new Provincial Working
Committee shall be formed after every new election of the Provincial Council.
During all such
conditions when the Provincial Council is not in session or it is difficult to convene it,
the Provincial Working Committee shall assume all the powers of the Provincial Council.
However, the Provincial Council shall have full power to ratify any of its decision or
action, or disapprove it in part or in whole.
6. Incharges of the
Provincial Departments
Appointment, Dismissal,
Duties and Powers (Article 51 b)
1. Each Provincial
Department shall normally be under a separate Incharge appointed by the Provincial
President according to his discretion.
2. An Incharge of a
Department shall continue in office only as long as the Provincial President is satisfied
with his work.
3. Duties and powers of
the Department Incharges shall be determined by the Provincial President.
