LAHORE, Apr 21: Jamaat-e-Islami ameer and MMA
president Qazi Hussain Ahmad has said that nation does not
acknowledge the Supreme Court created by an individual nor accept
its decisions. The ruling alliance should not use the present
supreme Court for its objectives and instead make amendments in the
constitution to bring it in its original shape and to eliminate the
amendments forced into it by an individual.
Qazi was commenting on the judgment of the Supreme Court declaring
the graduation condition for assembly candidates null and void on
Monday.
Qazi stressed that rulers should restore all judges including chief
justice Iftikhar Mohammad Chaudhri and avoid delaying the
impeachment of Gen Musharraf.
Qazi reminded that ruling alliance has promised the nation for
reversing the unconstitutional measures of Nov 2, 07 and restoration
of all sacked judges. He stressed that all the judgments of present
supreme court will become controversial after the restoration of
chief justice Iftikhar Chaudhri and other judges.
Qazi said his party had appealed the supreme court for the repeal of
the graduation condition much earlier but the court did not nullify
it at the time when it was needed. He said if this condition had
been nullified at that time it would have increased the prestige of
the supreme court.
Qazi emphasized that people have no trust over the Supreme Court
created after the unconstitutional act of Nov 2, 07 and all sections
including lawyers, democratic parties and civil society have not
acknowledged it. He said any decision to suit the requirements of an
individual will further bring bad name for the Supreme Court. He
asked the ruling alliance that it should use constitutional path for
making whatever changes it wanted to bring into the system instead
of taking support of the controversial Supreme Court. He said all
parties had already agreed in the London APC that 17th amendment and
LFO should be abolished to bring the constitution in its original
shape.
Qazi said Gen Musharraf had put the graduation condition to block
the way of religious parties to the parliament and had always used
it as a tool to put pressure on them. He said no such condition was
there before 2002 and all previous assemblies had worked better than
the graduate assembly, while the assembly which made the
constitution of Pakistan was also not graduate. He said the role of
graduate assembly was no more than a rubber stamp since it had no
role in policy making and decision of national importance, whereas
the individual used it for ratification of his dictatorial actions.
He said there was no difference in the standard and performance of
the national assembly before the graduation condition was imposed.
He said people have been justified in demanding that all powers of
decision and policy making should be in the hands of people's
representatives since it is the very purpose for which they are
elected and sent to the assemblies.
